What happens if I was in a car accident and the other driver doesn’t have insurance in Kansas?
Answer:
We had someone come in recently who was injured in a car accident in Kansas, but the other driver didn’t have any insurance coverage. What can you do if you’re in that situation where somebody causes a wreck, but they don’t have insurance? In Kansas, every insurance carrier is required to provide what’s called uninsured motorist coverage as part of your policy. Even if the other driver who caused the accident does not have insurance coverage, your own insurance policy on your vehicle should have insurance coverage that would step in and pay your damages as if they are providing insurance for the other driver. Then your insurance company works on collecting the damages from the responsible driver, but at least you don’t have to wait for that payment and can instead collect those benefits from your own insurance company.
It gets a little complicated in how to handle that, so it is helpful to have an attorney that can guide you through that.
