Question:
Who is responsible for my pedestrian accident medical bills in Kansas?
Answer:
We got a call the other day from someone who was injured in a pedestrian accident, and they wanted to know who was responsible for paying their medical bills from that accident. It’s a question we get a lot. The answer is that there are different insurance companies that are responsible for paying your medical bills, and oftentimes, there is an order to how those medical bills are paid and by which insurance company.
Initially, your medical bills will not be paid by the responsible party. If you have insurance on a vehicle in Kansas or are otherwise covered by what is called personal injury protection benefits or PIP coverage, your PIP coverage even as a pedestrian would cover your medical bills for your pedestrian accident injury. Once your personal injury protection benefits have been paid in full, then your health insurance will start paying your medical bills and pay your medical bills until you are done treating for that injury.
Once you are done treating, all of your medical bills, including those paid by your personal injury protection as well as your health insurance, will be submitted to the insurance carrier for the responsible party, and that insurance carrier will pay those medical bills, but they don’t pay those bills up front. They pay those bills after you’re done getting the treatment that you need. In can be difficult to navigate which insurance company is supposed to pay at which time. We can help you with all of that and make sure that ultimately your medical bills are paid by the responsible party in the end. If you have any questions about getting your medical bills paid or any other aspects of your pedestrian accident claim, please give us a call. We’d be happy to talk to you about that.
