        Question:

How does a bike accident claim differ from a normal auto accident claim?

        Answer:

We were talking to somebody the other day who was injured in a bicycle accident. We talked about the difference between a bicycle accident and a regular car accident case. There are a couple of significant differences. One, a person in a bicycle accident, the person riding the bicycle, is typically or can be more severely injured. They don’t have the protection of the car and so the injuries can be more significant and severe, in which case the damages can be greater and so it is important to make sure that you are recovering all the damages for your bicycle accident. Another way in which a bicycle accident differs from a car accident is that there’s a common belief amongst juries that if there was an accident with a bicycle, the bicycle rider was at fault in some way. They were riding the wrong way. They were not visible or not doing the right thing and therefor they are at fault. It is important to hire an attorney that understands that that’s not the case, that the rider of the bicycle is not always at fault and is able to present the case to the jury in a way that shows the jury that the bicycle rider was not at fault for this accident and recovered the injuries from the bicycle accident. If you have any questions about your bicycle accident case, please give us a call. We’d be happy to talk to you about that.
