Question:

Can a negligent security claim be filed if the attacker was an employee?

Answer:

We got a good question recently from someone. Their question was if they are injured by an employee, are they able to pursue a negligent security claim against the employer? The answer is yes. The employer has a responsibility to provide employees that can perform the job properly and who will not injure other people. If the injury is a result of the employer’s failure to either hire the right people, or train their employees, or supervise their employees, then you can absolutely pursue a negligent security case against the employer.

There are a lot of factual details that go into determining those claims and so it will be helpful to get an attorney involved right away. If you have questions about your negligent security case, just give us a call. We’d be happy to talk through that with you.
