She was concerned about how to go about determining who the best attorney is for her and her situation. She asked how she should make that decision. We mentioned a couple of things to keep in mind. The attorney that you know that has handled things for you in the past, maybe a traffic ticket or something like that, while they may be a very nice attorney, if they’re handling a variety of different things, legal matters, they don’t have a core focus in wrongful death cases. We really want to make sure you do have somebody who is really focused on handling wrongful death cases. There are certain details in the law that an attorney who focuses on wrongful death cases will know and will be able to present for you and get the best recovery for you.
You also want to make sure that you hire somebody that is skilled, experience, and has success in handling wrongful death cases. You want to make sure that you have somebody who has experience handling these, who knows how to work with the insurance carriers involved on these cases and knows how best to present your case to get you the best recovery. You also want to make sure that you find a trial attorney. A trial attorney is an attorney that will take your case to trial and to a jury trial if necessary. We got a call recently from somebody who was interested in pursuing a wrongful death claim. They had a good question: Who can pursue a wrongful death claim in Kansas? While there are some intricate details that go into answering that question, the short answer is that essentially an heir of the deceased person is who can bring that claim. That usually is a spouse or a surviving child. If there is no surviving spouse or surviving children, then it includes other family members, including parents of the deceased person.
